Ethics in Urban Planning Essay

What is the law on eminent domain all about? Eminent Domain is the power of the State over all the properties within its jurisdiction, both public and private. The purpose being to empower the State to appropriate property for public use – for new and road widening projects, bridges, military installations, public parks and even urban renewal (Larson, 2004). In case of private properties, how does eminent domain apply? Well, properties that the Government deems as vital for public use and welfare can be seized from private owners based on the provisions of the law on eminent domain. But the Constitution, particularly the Fifth Amendment, guaranties that â€Å"No person shall be †¦ deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation† (Hornberger, 2005). Is the law on eminent domain ethical? The answer is an absolute no. It may be legal but it does not hold any moral definition. It is still classified as large-scale theft that is backed up by legal parameters. We live based on the principles of morality that abhors theft. In fact, the customs and laws of all civilized societies prohibit any form of banditry. In the exercise of our individual freedom, we as a people have the right to use our property in ways we deemed fit – unless we infringe on the rights of other people (Tenney, 1995). In our democratic system, do we exercise our right of suffrage to make stealing legal? It sounds like people casting their votes simply because they wanted your property sequestered. Where do ethics apply then? What are the consequences? Basically, the law on eminent domain was enacted to provide a leeway for the government in the planning of its developmental projects. Projects include road improvement, probably runway extensions or perhaps public hospitals. Private lands are purchased by the government for this purpose, based on a fair market value and as guaranteed by the Constitution. This provision becomes necessary so that the government can proceed with development without the process of lengthy litigation. Lately however, the scenario has been altered with the law on eminent domain applied even on urban renewal. This is where the abuse of discretion engages a number of government officials, all in the guise of development. This scheme is morally repugnant though it does not end at that point because with the eminent domain as the carrot stick, this marginally reduces the purchase price of the property. What has government got to do with it (Tenney, 1995)? Remember that development plans rests solely on the hands of government, so a slight deviation on the zoning area reclassification would normally affect property values. Imagine if your property lies on a commercial zone and the government suddenly establishes it as part of an industrial zone, the real estate property value is likely to plummet due to rising environmental concerns. The consequence is you are likely to sell it at much reduced price. But this scheme is just the tip of the iceberg, as more devious schemes are in the offing. The most unforgiving plan of government involves the declaration of a specific area as suffering from urban blight. Blighted areas, for purposes of urban renewal, refers to areas that in the process of deterioration being a haven of uncontrolled vices (drug addicts, alcoholics and other scum of society) where the crime rate is really high or an area that is already rendered useless which may include vacant lands and air rights. Who will then determine if the property falls under the category of blighted areas? This will be up to the discretion of the government and most likely this is where abuse is glaringly documented, particularly in cases where the government is in cahoots with property developers. When this happens, government has the right to raze the property and sell it to developers with the intention of making it into an attractive urban development (Blight, 2001). In most instances areas that are declared â€Å"urban blights† normally conforms to urban redevelopment. Areas that suffer from these types of classifications are low-cost housing communities with correspondingly low revenues where homeowners who have been in domicile for years while paying regular amortization to secure rights to the property. In these instances, these homeowners are suddenly met with the prospects of relocation. With the area categorized as such, the real property value is extremely low that the proceeds of the sale are not even enough to pay for the downpayment for another unit in a new housing development site (Parlow, 2007). What about areas in commercial districts that have been subjected to the process of eminent domain? The owner may have lived or conducted business in the area for the past twenty years but the government has the temerity to invoke the provisions of eminent domain to take control of said property simply because the adjacent school needs a playground or perhaps a football field. Where do ethics come in or is this just plain common sense? If you are the owner of the property, will you be not in arms to stop the proceedings? Where is morality then? We trumpet the virtues of democracy to the outside world and yet in our own backyard we practice anarchy (Parlow, 2007). This will all redound to displacement of all families affected by the claws of eminent domain. Families will be evicted from their properties – good if there is a ready site for relocation at least people can endure the inconvenience. But in most cases no relocation areas have been secured. Families will now be subjected to the task of searching for a new place as a consequence of eviction. What about their transportation need to and from work, school for their children and perhaps the affordable medical services that were readily available in their previous area (Blight, 2001). The final consequence maybe and I hope that this will not be met by evicted homeowners or storeowners or they could be relegated as the new scum of society, being degraded to a bunch of homeless citizens that have the potential of creating troubles for the government. The government shall have increased the problems associated with the housing needs and get the ire of the population. What then has this accomplished for the government in the end? Nothing, except perhaps that it compounds the problems of the locality (Hornberger, 2005). The law really smacks moral decadence, for how can you humanly evict families from their abodes without paying them fairly. Some may have inherited the property and as an ancestral abode, no amount would suffice in return for its sentimental value in the same way that no amount could compensate for the Statue of Liberty, being the symbol of freedom that Americans deeply treasure. How can you possibly sell an heirloom – a gift from the people of France, this is no longer a question of ethics, not even morality though it borders on bad taste and greed. What are the effects? Proponents of the measure on eminent domain will always sing the sad melody of development. Be that as it may, we can never stop development from happening because it is dictated by the social status of the locality. But can we not negotiate with property owners so they can also profit from the property they have tenuously preserved and paid for? It is more of a question of fair value for their property, an issue that is often ignored. Even for this gesture alone, the government, particularly the developers will benefit from the support and approval of the property owners. Let us not bully our neighbors by invoking the right of eminent domain, because that simply will not work. Who then does not desire physical development? When it means convenience to the inhabitants, particularly interchanges, super-highways, a modern airport terminal, a dazzling sports arena, an upbeat school campus or a modern hospital. Urban development on formerly blighted areas will be a big boost to the local trade as new shopping malls, five-star hotels, office towers and condominiums will be constructed. The local labor force will benefit as well, since hundreds or maybe thousands of jobs will be made available. It will be a shot in the arm for the local economy since development will encourage a lot of investors to take a chance on the improved infrastructure facilities. The government will likewise benefit from increased revenues and create more funds to finance the needs of local inhabitants. But most of all, this would drastically alter the locality’s image and skyline for the better. With a booming economy, the government can now plan ahead. Maybe exploit some more the bonanza that the new development concurred and build additional facilities to meet the increasing population requirements. As the citizen’s quality of life improves, new facilities will be needed, housing shortage will be felt, traffic congestion is possible as more and more cars will ply the streets and entertainment will be the call of the majority. The problems associated with crime and security will quadruple, new personnel will be added, police cars and gadgets will be required by our law enforcement agencies. There will be no stopping, once the wheel of development starts to roll. Then when everything seems to have settled and everybody is accustomed to the set-up, the arms of development will try to break the already serene environment. So the government will now invoke their right of eminent domain and the result, chaos strikes once again. It will be an unending cycle. The population will simply have to bear inconvenience and unfair treatment in the name of development. It is in the outlying implementation of eminent domain that government failed because officials can be motivated only with the expected revenues from the urban renewal project to disregard their main advocacy and moral obligation to its constituents – to promote, protect, and upheld the rights of the populace. Conclusion The moral and ethical question of the law on eminent domain had been subjected to criticisms from all sectors of society. It may be an effective tool for government to spice up development, but it oftentimes falls oppressive to many property owners. Sadly, the people’s right to their property has been trampled once again with no less than the Supreme Court of the United States stamping its approval on the right of government to invoke the provisions of eminent domain. Consider this. In 1954 the Supreme Court gave a ruling in a controversial case that â€Å"effectively gave government officials unlimited power to confiscate and redistribute lands†, arguing that â€Å"the concept of public welfare is broad and inclusive. The values it represents are spiritual as well as physical, aesthetic and monetary. It is within the power of the legislature to determine that the community should be beautiful as well as healthy, spacious as well as clean, well-balanced as well as carefully patrolled† (Tenney, 1995). The comment of the High Court was indeed a chilling premonition since this gave government officials the legal right to evict anybody from their properties when necessary and at their convenience. In effect this erased the intentions of our forefathers and the framers of the Constitution the absolute right of individuals to hold on to their properties (Tenney, 1995). Just recently, in a new and daunting case of Kelo vs. City of New London, Connecticut, the High Court upheld the previous ruling of 1954. In fact after due proceedings, a notice was posted at the door of the petitioner’s home stating that the petitioner have four months to vacate the property or else power police power will be used to prosecute the order based on the power of eminent domain (Larson, 2004). Is the ruling even fair? Is it morally correct to inflict undue suffering to the respondents? And is it ethical? The answer is no. That is why all the States of the Union are putting up legislations to curb the damning influence and abuse on the power of the law on eminent domain. Capabilities and Core Competencies to execute its Business Model SAS possesses many capabilities and competencies to help execute its business model effectively. With a strong leadership spearheaded by CEO Jim Goodnight, coupled with a strong brand, SAS is able to recruit and retain the key talent it requires to execute its business model. Having a corporate culture which is egalitarian and based on mutual trust and respect also plays a significant role in retaining talent and keeping employees loyal and happy. With a dedicated human capital striving to continue the company’s growth, SAS does not only come up with innovative products which increase its revenue, it also saves more than $100million due to its low attrition rate. Key Success Factors The key factors are its unconventional management philosophies, customer driven developmental process and it being a private company. Unlike other software companies that focus on monetary benefits, SAS’s management philosophy is mainly employee centred with the provision of many intangible benefits. It also believes in a long term view of all issues and does not actively strive to reac h specified short term financial goals. These have led to a build up of a loyal and talented workforce and sustainable long term growth. Moreover, its products are built on customer needs and customer feedback is taken very seriously. Using the Voice of the Customer (VOC) approach, customer opinions and suggestions are compiled and used to guide the development process. Building of Capabilities and Core Competencies via People Management Practices With attraction and retention of talent central to the company’s continuing success, it has developed certain principles in its recruitment, compensation, employee benefits and outsourcing policies. It has a stringent recruitment process to ensure the cultural fit of its new hires and thereafter gives its employees as much autonomy as possible. It also actively promotes a work life balance and egalitarian culture with a promotion of non financial incentives, unlike other software firms thus creating a unique corporate culture, â€Å"One of cooperation, teamwork and mutual respect† . As shown in the diagram above, this leads to increased customer satisfaction and thus increasing revenues. All in all, these practices have helped promote the building of its capabilities and competencies to a large extent ?Is the SAS Model perfectly in balance? With SAS focussed on long term growth and emphasizing non monetary benefits for its employees, this model has been almost perfect for them. It is not fair to say that the model is perfectly in balance as a firm’s model is largely determined by its capabilities and core competencies. A public company for instance would not enjoy the flexibility that SAS enjoys. It would not be able to provide such extensive employee benefits or focus on long term growth at the expense of short term profitability. No model can fit all organizations and be perfectly in balance and SAS is not different. For example, if its model is in balance, its attrition rate despite being low would be 0 and not 4%. 4. Difficulties in imitating SAS’s approach Being such a differentiated company compared to the rest of the industry in many aspects, it is difficult to duplicate SAS’s approach which is based heavily on intangible assets. â€Å"†¦intangible assets almost never create value by themselves. They need to be combined with other assets. † Hence, not only do these intangible assets such as SAS’s unique corporate culture take years to implement, it is also hard to imitate as the social complexity of a company's culture is so ambiguous that it is almost impossible to find out how it works and combines with each other. ?Why few firms have tried to implement many of its People Management Practices Big companies with strong brands such as IBM could follow its stringent recruitment process but would not be able to imitate its unique culture as easily. With most companies providing incentive compensations and stock options, it would not be easy to eliminate that and emphasize non-monetary incentives. This is especially so when public companies would have to go through its board just to provide employee benefits on a similar scale as SAS. It would also be unfeasible to bring outsourced functions back in-house as it would most certainly drive up labour costs and hence be blocked by a hard-nosed board. 5. Extent to which SAS is dependent on continuation of its CEO With a flat organization structure and having 27 direct reports, Goodnight also appears o be very much on top of all the details of the organization. Conversely, he appears to give his direct reports a clear direction of where SAS Institute is going on the product or technology front, and then let them run their own areas. Even though Goodnight is no longer directly involved with most decisions related to SAS’s work culture, his original vision has spawned a self-perp etuating culture, and â€Å"new† decision makers now share his vision, which governs the variety of philosophies, strategies, and practices adopted by the company since its inception. Even though the culture looks so strong that it would survive a change in leadership, the new CEO would not only have to possess business leadership ability but also shares the same values as Goodnight so that SAS does not deviate from its current approach to its business and management. Hence, with no formal succession planning and still being heavily involved in almost all aspects of the organization, the SAS institute approach to its business and management is heavily dependent on Goodnight’s continuation. . Theory of Human Motivation and Behaviour underlying SAS’s Management Approach Maslow’s Needs Hierarchy seems to underlie SAS’s approach to people management. 7. Barriers in implementing knowledge of how SAS manages its people Firstly, a barrier in trying to implement freedom and autonomy coupled with possessing employees with intrinsic motivation is not only the lack of talent but finding talent with the required characteristics. Secondly, extensive employee benefits such as a gym, day-care and the absence of commission-based pay for its account representatives would most likely not been possible if a company is public. Thirdly, a lack of explicit support and encouragement from top management would be another barrier as this is important for the promotion of an egalitarian culture based on trust and mutual respect on top of a family-friendly atmosphere. 8. Major Challenges SAS may face in the next 5 years and its Impact Due to the changing dynamics of the software industry and increasing global competition, the company has to expand its talent pool which is already in shortage. Hence, there might be a need for the company to come out with new ways to attract talent. Practices such as providing more career advancement opportunities would be important in retaining them. Another challenge would be to develop current staff to meet future needs whilst nurturing its talent to fulfil their potential. SAS might have to change its current unstructured approach where employees are free to come up with and develop their own projects and idea. A more structured approach to its job design could be considered to help nurture and develop staff. In general, SAS’s practices have been working for them and look to be able to continue to help them succeed. However, certain aspects could be improved in the future to overcome potential future people management problems such a new generation of workers demanding a different set of benefits than the one SAS currently offers. . There should also be a strong relationship between management and employees to produce competitive advantage, hence SAS’s promotion of an egalitarian culture. ?Future of HRM in firms like SAS The future of HR should be one that is committed to working with line managers to improve SAS’s bottom line, create service value for customers and create workplace value for employees. Leadership and management training should be initiated for senior managers while knowledge sharing within the HR function would be vital for SAS to move forward and expand globally. HR should also become a champion for employees while working to increase employee contributions, specifically commitment and ability to deliver results, be an agent for continuous transformation, and cultivating a culture that will improve SAS’s capacity for change.

The transportation of nutrients to the other parts in the body is enhanced by the blood and nerves (Smith & Morton 2001). There are however some factors that have a negative effect on the process of digestion, one of these factors is malabsorption. Malabsorption is t he condition where the nutrients are not absorbed in the intestinal walls during digestion. After the breaking down of the foods, they are blend with the digestive juices to produce nutrients which are then absorbed by walls of the small intestines to generate energy. The various types of malabsorption include sugar malabsorption for lactose, fat malabsorption for which is mainly caused by a fault in either the bile ducts, small intestines or the pancreas. Nutrient malabsorption is caused by failure in transportation of nutrients such as iron and minerals. Malabsorption is mostly caused by disorders in the walls of the small intestines. The intestinal walls are made up of the villi and microvilli that are responsible for providing a large surface for absorption of nutrients. Therefore a fault in any part of the small decreases the surface for absorption. Faults in the intestinal walls are mainly caused by diseases such as celiac and Crohn's. However, some faulty intestinal walls are due to infections by bacteria, parasites, virus and certain drugs such as alcohol and antibiotics. Some of the external symptoms of malabsorption include loss of hair, swelling of some body parts and dry skin. Malabsorption causes illnesses such as anemia, heart failure, gallstones, rickets and Osteoporosis which affects the bone strength. The other condition that affects the process of digestion is malnutrition. Malnutrition is the situation where the diet that a person takes is not sufficient to meet the nutrient requirements in the body (Sizer & Whitney 2010). For digestion to take place efficiently the body needs adequate quantities of various nutrients which include minerals, fats, carbohydrates, proteins and vitamins. One of the reasons for malnutrition is due to lack of food due to hunger. The other cause of malnutrition is when a person’s diet is limited to foods with no nutrients (Brynie 2002). Malnutrition may also be caused by situations where the body requires mo re energy than the body is generating. These factors lead to the lack of essential nutrients in the body. Malnutrition may also be caused by certain medical conditions that affect some organs of the digestive system. The lack of different nutrients in the digestion process cause different types of malnutrition thus varying symptoms (Sizer & Whitney). Much has been said about the benefits and principles of RTI models for children with special needs. Psychologists welcome the implementation of RTI models and principles for exceptional children, including those with autism. Unfortunately, the effects of RTI on autistic children and their behaviors remain unclear. This paper reports the results of RTI usage in children with autism. A brief review of literature is performed. Methods and results of the intervention are discussed. The goal of the study is to see whether RTI can be successfully applied to enhance emotional stability and behaviors in children and adolescents with autism. Literature Review Response-to-Intervention (RTI) is a popular object of present day research. RTI is claimed to be an innovative approach to delivering learning and psychological/ emotional services in schools (Barnes & Harlacher, 2008). RTI is fairly regarded as a relevant, proactive response to the emotional and behavioral difficulties faced by school children in their striving to meet at least the basic learning objectives (Barnes & Harlacher, 2008). ... According to Barnes and Harlacher (2008), RTI relies on the five main principles. First, the model is both proactive and preventative (Barnes & Harlacher, 2008). Second, RTI ensures a strategic emotional and instructional fit between the student, student’s needs, and the curriculum and instruction (Barnes & Harlacher, 2008). Third, RTI builds on data-based decision-making and is problem-solving-oriented (Barnes & Harlacher, 2008). Fourth, RTI relies on the use of effective instructional practices; and fifth, it is a systems-level approach (Barnes & Harlacher, 2008). To a large extent, the use of RTI does not merely allow identifying students with special learning needs but creates the basis for improving their learning outcomes (Barnes & Harlacher, 2008). Barnes and Harlacher (2008) specify that the principal features of RTI are (1) multiple tiers; (2) a complex system of assessment; (3) a sophisticated protocol; and (4) evidence-based instruction. Here, the complex relationsh ip between features and principles of RTI becomes evident. Multiple tiers reflect and reinforce the proactive nature of the model and create a foundation for achieving the instructional match between the student, student’s needs, and instruction/ curriculum. The assessment system inherent in the RTI is integrally linked to the model’s problem solving orientation. The protocol as the third most important feature of RTI is inseparable from the principle of effective practices, whereas evidence-based instructions and practices support the systems-level character of RTI (Barnes & Harlacher, 2008). Suffering in Shakespeares Works Essay The prominent metaphor used throughout Shakespeare’s sonnets and â€Å"Twelfth Night† is the comparison of love to suffering. This metaphor is brought up many times in â€Å"Twelfth Night† by different characters which exaggerate the suffering caused by love. Most of the sonnets written by Shakespeare compare love to suffering, but the sonnet that exemplifies it the most is sonnet 147. These two works written by Shakespeare are similarly connected through word choice to set up the metaphor of love as a painful experience. â€Å"Twelfth Night† is a romantic comedy, and even though the play ends with almost all characters happy, Shakespeare demonstrates just how painful love can be. This suffering that different characters experience is either from being in love or unrequited love. At one point during the play Orsino compares his love for Olivia as an â€Å"appetite† (I.i.1–3) that he can never fully satisfy while later he describes his desire for her as â€Å"fell of cruel hounds† (I.i.21). This word choice chosen by Shakespeare provides the reader with a clear metaphor that love within this play is viewed as cruel. Furthermore Olivia describes her love as a â€Å"plague† (i.v.265), that word carries a negative connotation that cannot be construed in any way to be positive. All of these metaphors are continued throughout the play by varies characters all complaining about their sufferings with words pertaining to a degree of violence. Similarly in Shakespeare’s sonnets the metaphor of love as being cruel and painful can be seen with his particular word choice. The opening line of Sonnet 147 sets the mood for the entire poem with comparison of love to sickness thus continuing the metaphor of love as a dreadful experience. Comparing love to a â€Å"fever† that is â€Å"longing still† (1), Shakespeare creates a discouraging outlook of unrequited love. Furthermore it continues with accusing the unnamed recipient of â€Å"Feeding on that which doth preserve the ill† (3). Not only is Shakespeare complaining about being in love without reciprocation, but he blames the unnamed person for his sickness. This metaphor of love being torturous is continued throughout the rest of the sonnet, ending on a very morbid couplet â€Å"For I have sworn thee fair, and thought thee bright, / Who art as black as hell, as dark as night† (13-14). The word choice of the couplet shows the pessimistic view of unrequited love, thus clearly indicating the extended metaphor of suffering while in love. Love described by Shakespeare is a terrible sickness that no one should have to endure, which is typically not the mindset of most people when they think about love. However, given the context in which Shakespeare wrote these two works, it is clear that he was bitter because of his own personal unrequited love from a woman. This unrequited love is portrayed in almost all of Shakespeare’s sonnets, however Sonnet 147 described the most dark and miserable aspects of love. â€Å"Twelfth Night† portrays the suffering of love through word choice similarly to Shakespeare’s sonnets; however in the end all the confusion sorts itself out unlike Sonnet 147. The extended metaphors within these two pieces express the emotional suffering of unrequited love as written by William Shakespeare.
